New Technology Enhancements Featured in Qualcomm’s Chipsets Offer Doubled Voice Capacity for CDMA2000 Networks

LAS VEGAS, April 01, 2008 — Qualcomm Incorporated (Nasdaq: QCOM), a leading developer and innovator of advanced wireless technologies and data solutions, today announced new enhancements to CDMA2000® network technology. Operators will now be able to support more than double today's capacity of 35 simultaneous calls in 1.25 MHz of spectrum while delivering the same level of voice quality. The new levels of efficiency not only meet the growing demand for voice connectivity, but also enable the freed-up bandwidth to be used to expand 3G data services, enabling operators to maximize their 3G network investments for voice and mobile broadband. This flexibility is critical to promote an economical rollout of next-generation networks - concentrating 4G technology deployment in areas where more bandwidth is required and leveraging the optimized 3G network for systemwide voice and data services. » read more »

Qualcomm is the Largest User of Nokia Technology, Patents

ESPOO, Finland, April 13/PRNewswire-FirstCall/ -- Nokia (NYSE: NOK) today rejected Qualcomm's public statements that it does not use Nokia patents. Nokia has for the last fifteen years contributed its technology to industry standards, such as GSM, WCDMA and CDMA. If Qualcomm's products comply with industry standards it is in the same position as any other supplier of mobile technology in that it needs access to Nokia's patents covering standardized technologies.

Nokia believes that Qualcomm is currently using over one hundred of Nokia's GSM/WCDMA and CDMA2000 essential patents in its chipsets. Nokia and Qualcomm are yet to agree on the compensation payable by Qualcomm for such patents. With its more than 200 million units annually, Qualcomm is the largest user in the world of Nokia's technology and patents. Nokia's request for royalty payments from Qualcomm is based on royalty levels which are fair, reasonable and non-discriminatory (FRAND).

Since the early 1990's Nokia has invested over $35 billion in R&D and built one of the wireless industry's strongest and broadest IPR portfolios with over 11,000 patent families. » read more »

Federal Court Rules Against Qualcomm in H.264 Video Compression Patents Case, Broadcom Says

Broadcom Corporation announced that a federal district court adopted a unanimous jury finding that Qualcomm Incorporated violated its duty to disclose patents to an industry standards body and thereby waived its rights to enforce two patents Qualcomm alleged covered the H.264 video compression standard.

Qualcomm filed suit against Broadcom in San Diego federal court in October 2005 alleging that Broadcom® products infringed the two patents, and on January 26, 2007, a unanimous jury found that Broadcom did not infringe the patents. The jury also rendered advisory verdicts that Qualcomm committed inequitable conduct before the USPTO, and that Qualcomm knowingly violated a duty to disclose its patents to the Joint Video Team, or its parent organization, during the JVT's preparation and eventual adoption of the H.264 video compression standard.

In a 34 page opinion, the Court found:

    * "Qualcomm waived its rights to enforce the '104 and '767 patents against H.264 products by its silence in the face of a "clear duty to speak" to identify to the JVT its IPR related to the development of the H.264 standard" » read more »

Nokia Sues Qualcomm for Patent Exhaustion in Germany and the Netherlands

Nokia announced today that it has filed complaints against Qualcomm in Germany and the Netherlands requesting declarations that Qualcomm's European patents are exhausted in respect of products placed on the European Union (EU) market with a Qualcomm license, in this instance chipsets supplied by Texas Instruments. Texas Instruments and Qualcomm are publicly known to have entered into a so called Patent Portfolio License in 2000.

If Nokia's claim succeeds, Qualcomm would be prevented in Europe from enforcing its respective patents in relation to Nokia handsets incorporating such chipsets.

The complaints were filed in the Regional Court of Mannheim (Germany) and in the Hague District Court (the Netherlands); both courts have substantial experience in patent matters within the EU.

Since the early 90's Nokia has invested approximately €30 billion in research and development and built one of the wireless industry's strongest and broadest IPR portfolios with over 11,000 patent families. Nokia is a world leader in the development of GSM technologies, and its evolution to WCDMA, which is also demonstrated by Nokia's strong patent position in these technologies. » read more »

In Turn, Broadcom Dismisses San Diego-based Counterclaims, but Proceeds With Cases Against Qualcomm in All Other Venues

Broadcom Corporation has announced that Qualcomm Incorporated has agreed to dismiss all remaining cases initiated by Qualcomm and awaiting trial against Broadcom including Qualcomm's claims of patent infringement and trade secret misappropriation in San Diego.

In turn, Broadcom dismissed its counterclaims against Qualcomm in those San Diego cases. Broadcom's claims of patent infringement against Qualcomm in U.S. District Court in Santa Ana, Calif. and in the U.S. International Trade Commission (ITC) in Washington, D.C., and Broadcom's antitrust claim against Qualcomm, which is on appeal in the United States Court of Appeals for the Third Circuit, are not affected by the dismissals in San Diego, and will continue forward.

The remaining Broadcom patent cases against Qualcomm are:
