Leading Competitive Telecom Companies Ask FCC to Deny AT&T-BellSouth Merger

Largest RBOC to RBOC Merger in History Must Be Denied or Have Strict and Enforceable Merger Conditions to Protect Public Interest

June 06, 2006 -- WASHINGTON, DC - A group of the nation’s leading competitive telecommunications companies have filed comments urging the Federal Communications Commission to deny the merger of AT&T and BellSouth, citing the irreparable harms to competition and the public interest that would result from the largest RBOC to RBOC merger in history of the telecommunications industry. The companies that filed the comments are Cbeyond Communications, Grande Communications, NuVox Communications, Supra Telecom, Talk America, XO Communications and Xspedius Communications.According to the group, the AT&T and BellSouth merger only serves to create a larger monopoly that will have an even greater ability to thwart competition through its increased control of local networks and dominance over intra-modal services. Through its acquisition of BellSouth, AT&T – which is already the nation’s largest provider of local voice, long distance, and broadband DSL services – will increase its dominance of these wireline-based services, extend its monopoly to 22 states and become the nation’s largest wireless provider, creating the nation’s largest intra-modal services RBOC.

The group outlined three overall areas that the combination of AT&T and BellSouth will bring significant harms to consumers and businesses. They include:

• Eliminating Existing and Future Competition between RBOCs. As adjacent RBOCs, AT&T and BellSouth are the most significant current and potential competitors to one another in the consumer and business telecom services markets. Both companies have significant network assets in each other’s regions.

• Undermining the Implementation of the Telecommunications Act of 1996. The AT&T and BellSouth merger will undermine the ability of regulators and competitors to implement the pro-competitive, deregulatory framework for local telecommunications that was adopted by Congress in the Telecommunications Act of 1996.

• Increased Incentive to Discriminate Against Competitive Providers. By extending its monopoly control over local network facilities in BellSouth’s territory, AT&T will have an increased incentive and ability to discriminate against competing service providers in retail markets that depend on access to AT&T’s local network facilities in order to provide service.

Speaking on behalf of the group, Heather Gold, senior vice president of government relations at XO Communications, said, “The time has now come when the FCC must ask itself, ‘Are we going too far this time?’ This merger will do nothing to bring more competition and choices for consumers and businesses. It will concentrate even more market power in the new AT&T, which is quickly reassembling the old Bell System. The FCC needs to say that enough is enough, and stop the incessant effort of AT&T to reestablish its nationwide wireline monopoly by using monopoly profits to gobble-up its competitors, rather than by competing for customer loyalty through innovation and service.�

If the merger is not denied, the group asked the FCC to impose stringent and enforceable conditions to offset the enormous anti-competitive effects of the proposed merger. The group noted in its comments, that the FCC imposed merger conditions on previous RBOC to RBOC mergers that the merging companies simply ignored or which were not enforced.

“We have been down this road before of failed promises following previous Bell to Bell mergers, like those of SBC and Ameritech,� said Gold. “The conditions on this merger must have strong enforcement mechanisms with severe penalties if they are not followed. The function of regulatory agencies is to enforce its policies, not to rubber stamp industry actions which thwart those policies.�

The group’s comments discussed more than twenty specific conditions involving access to AT&T and BellSouth network facilities and services and divestitures of overlapping network assets that the FCC should impose on AT&T and BellSouth if the proposed merger is approved, including:

• Ensure continued access to existing AT&T/BellSouth “section 251� unbundled network elements at rates capped at current levels;
• Require AT&T/BellSouth to file with states just and reasonable rates for “section 271� network elements;
• Ensure continued access to AT&T/BellSouth special access services at rates capped at current levels and on a non-discriminatory basis and with a “fresh look� period to permit customers to change providers without incurring penalties;
• Continue to offer AT&T’s wholesale private line services at current rates in BellSouth territory;
• Provide access to copper loops decommissioned by AT&T/BellSouth;
• Eliminate eligibility criteria on EEL UNEs; and
• Divestiture of AT&T’s metropolitan network assets in BellSouth territory and BellSouth’s wireless assets, including licenses in the 2.5 GHz range.

Results of Nokia Nseries Study Reveal Widespread Consumer Demand for Digital Convergence

June 06, 2006 -- Espoo, Finland - Almost one in two people around the world now use their mobile device as their main camera, over two thirds predict a music-enabled mobile will replace their MP3 player and nearly half want to connect up their mobile device with their home electronics. According to new research from Nokia, consumers are not only embracing convergence but clamoring for more of it.With more and more functionality being packed into mobile devices, Nokia Nseries, Nokia's high performance multimedia range, commissioned research in 11 countries around the globe to discover people's views on today's and tomorrow's multitalented mobiles.
The world's growing love affair with mobile devices
Multifunctional mobile devices have already replaced certain gadgets in people's lives. Nearly half of respondents (44%) use their mobile device as their primary camera, with India being home to the most prolific mobile photographers (68%). Globally, seventy two percent now don't use a separate alarm clock and 73% use their mobile as their main watch or clock.

When it comes to surfing the web on the move, over a third (36%) of respondents are browsing on their mobile devices at least once a month. Inevitably, Japan leads the way in mobile internet usage with 37% admitting to going online on their mobile on a daily basis.

With an ever increasing list of features, it's not surprising that people can't imagine life without a mobile: 94% of those questioned plan to have a mobile in the future. People in Brazil love mobiles so much that 100% believe they'll own a mobile device in years to come. In fact, mobiles are so indispensable that over one in five (21%) would be more upset about losing their mobile than their wallet, credit cards and even their wedding ring.

Recording the impact of mobile music

Digital music has completely re-shaped the world's music buying and listening habits: the study found 67% of people around the world now download a percentage of their music and 87% claim their music in-take has increased since owning a digital music device. Germany clocks up the most listening time: 28% admit to listening to 21 hours or more of music every week. And what is the world listening to? Pop (35%), followed by rock (21%), dance (8%) and classical (7%).

Music-enabled mobiles devices are set to be at the heart of future digital music consumption: 67% predict the mobile phone will replace their MP3 player.

A home run by mobiles

According to Nokia's research, the world is embracing the concept of the mobile digital home where mobile devices act as household remote controls, beaming digital content like music and photos to compatible domestic devices. Almost half (42%) of respondents globally want their printer, PC, stereo, TV and mobile device interconnected. It's Saudi Arabia that is set to be the home of the digital home - 72% even want their refrigerator included in this network.

And looking to the future, more than one in two (58%) of those questioned would like to be able to control all their household appliances via their mobile device. This is especially true in India (85%).

Commenting on the findings, Tapio Hedman, senior vice president of marketing, Multimedia, at Nokia, said: "The results strongly demonstrate that people are buying into the idea of convergence - they really do want one device that does it all, from taking quality images, to storing their music collections and operating a digitally connected home. Our goal is to make it easy for people to have all of these experiences with them all the time - in a multimedia computer. "

June 06, 2006 -- Espoo, Finland - Hong Kong operator CSL has chosen the Nokia MSC Server mobile softswitch to expand its network capacity and pave the way for smooth network evolution in the future. Nokia will provide installation, commissioning and technical support to CSL. Deliveries will start in June 2006, and the system will be operational by the end of this year."In the extremely competitive Hong Kong market we need to constantly improve our network and keep abreast of mobile technology development in order to provide quality services to our customers. Nokia's mobile softswitch will help to modernize our network, increase its capacity, and enhance the capabilities," says Adam Wong, Director, Mobile Networks, CSL.

"The Nokia MSC Server implements packet technology within core networks in order to optimize voice traffic and network operation. The MSC Server supports both traditional GSM systems and 3G circuit-switched traffic, making it possible to build and operate multimode networks more efficiently," says Mike Wang, General Manager, Hong Kong and Taiwan, Networks, Nokia.

The agreement extends the two companies' cooperation, which began in 1991 when Nokia became the first GSM supplier to CSL. Nokia has supplied GSM and WCDMA core and radio network equipment to CSL.

The mobile softswitch for CSL highlights Nokia's leadership in mobile softswitch deployment in China. To date, Nokia MSC Server System capacity of more than 20 million lines has been put into operation in the Chinese market.

Mobile softswitching and IMS are the main elements in converging networks. With over 90 customers for the MSC Server, Nokia has delivered the majority of the world's commercial 3GPP-compliant mobile softswitches, accounting for over 75% of Nokia's switch deliveries. Nokia is also the front-runner in IMS for fixed and mobile networks, with over 80 references for IMS solutions, such as Push to talk over Cellular and video sharing.

Acquisition mutually strengthens both companies' respective delivery and services strategies

June 05, 2006 -- Atlanta and McLean, VA, USA - Nokia (NYSE: NOK) and LCC International Inc., (NASDAQ: LCCI) announced today that the companies have reached an agreement for LCC to transfer its U.S. deployment operations to Nokia. Deployment operations include civil works and site acquisition services. As part of the agreement, a number of LCC's existing U.S. deployment contracts and assets used to support the U.S. deployment operations will transfer to Nokia upon completion of the deal which is expected to close within the next 45 days. The agreement will impact up to 80 LCC employees, many of whom will have the opportunity to become Nokia employees.

Today's announcement further enables Nokia and LCC to execute on their respective strategies within the wireless sector. For Nokia, this move addresses operator demand for a partner that can deliver a complete range of services, from deployment operations to consulting and integration to managed services. Delivery services, in particular, continues to be a significant area for operators as they seek to reduce operating expenditures. The addition of LCC's deployment operations to Nokia's delivery services portfolio enhances a highly experienced team to execute network rollouts across the country. LCC continues to expand its world class engineering and wireless consultative services operation.

LG Electronics (LG), a world leader in mobile TV technology, launched the world’s first 3G UMTS(WCDMA) TDMB(Terrestrial Digital Multimedia Broadcasting) handset in Europe.

The company provided 400 of its LG-V9000 handsets to BLM (Bavarian Regulatory Authority for Commercial Broadcasting) at the ‘TDMB World Cup Trial Service Conference’, held today at the Literatur Haus in Munich, Germany. The LG-V9000 is the only model which meets BLM’s technology requirements for mobile TV phone. It will be used by members of the World Cup Committee and international media during the World Cup trial service, allowing them to watch digital broadcasts of World Cup matches while on the move.Mr. James Kim, President & CEO of LG Electronics Europe, said, “Customers will experience UMTS(WCDMA) TDMB technology firsthand with the LG-V9000. This phone can provide the highest-quality World Cup video footage to our European customers, compared to other TDMB products. This model is a testament to LG’s creativity and state-of-the-art technology, which is driven by the pursuit of providing fun and convenience to customers in their everyday lives.�

At the conference, LG also showcased its latest TDMB products including handsets, laptop computers, PDA, and car terminals, in front of industry VIPs. LG’s demonstration showed how TDMB technology in real life. Attending the event were senior executives from BLM, Debitel, MFD, T-Systems, and WorldDAB, as well as the Korean Minister of Information and Communications and researchers from top electronics and telecommunications research institutes in Korea.

The LG-V9000 supports GSM (2G), GPRS (2.5G), UMTS(WCDMA) (3G) and TDMB as well, providing the most advanced TV viewing features. With its 2.2-inch wide-swing LCD, users can watch TV programs for up to three hours straight and even record one-hour programs the phone’s large memory capacity. Using LG’s internally developed DMB chip, the V9000 provides a perfect picture on a high-resolution screen and has a 3D surround sound system.

LG also launched the LG-U900, the world’s first commercially available UMTS(WCDMA) DVB-H phone through Hutchison in April, 2006. With its success, LG has earned a reputation as the leader in mobile TV technology, developing handsets compatible with all mobile TV standards.

DMB(Digital Multimedia Broadcasting)

DMB technology enables users to watch terrestrial broadcasts of the best image quality and talk on the phone simultaneously, thanks to the adoption of the LG’s internally developed DMB-receiving System-on-Chip (SoC) which incorporates “Mobile-XD engine.� The terrestrial DMB SoC can be applied to mobile phones, notebook computers, PDAs, and car terminals. With LG’ DMB technology, the terrestrial DMB phone resolves problems surrounding bulky terminals and power consumption issues.

In September, 2004, LG was first to develop the TDMB (Terrestrial DMB) receiving System-on-Chip (SoC). The company also developed Advanced Technology Systems Committee (ATSC), a standard for digital TV broadcasting.

LG’s DMB phone is a historical achievement in DMB technology. For the first time in the world, a mobile phone is able to play H.264 at 30 fps (frames per second) and take advantage of the VHF 200MHz TDMB frequency. Moreover, it boasts pioneering technologies, enabling digital TV broadcasting to be viewed on its high-resolution LCD, a large memory capacity and a longer-lasting battery.

TDMB service was launched in December 2005 in Korea and TDMB handsets have been promoted since early 2006.
